These terms apply to the purchase of physical goods (apparel and accessories). For the licensing and purchase of our font software, our General Terms and Conditions apply instead.
§ 1 Scope
(1) These Terms govern all contracts for the sale of physical goods ("Goods") concluded between you and Softdrive® Foundry, Görlitzer Straße 52, 10997 Berlin, Germany ("we", "us").
(2) They apply to the exclusion of any conflicting terms of your own, unless we have expressly agreed to them in writing.
(3) A consumer is any natural person who enters into this contract for purposes that are predominantly outside their trade, business or profession.
§ 2 Conclusion of Contract
(1) The presentation of Goods in our online shop does not constitute a binding offer. It is an invitation for you to place an order.
(2) By completing the checkout process and clicking the payment button, you submit a binding offer to purchase the Goods in your cart.
(3) We will confirm receipt of your order by email without undue delay. This confirmation of receipt does not yet constitute acceptance of your offer.
(4) The contract is concluded when we send you a dispatch confirmation, or at the latest when the Goods are handed over to the carrier. Should an item be unavailable, we will inform you and refund any payment already received without undue delay.
(5) The contract language is English. We store the contract text but do not make it separately accessible; please save these Terms and your order confirmation for your records.
§ 3 Prices, Shipping Costs and Payment
(1) All prices stated are total prices in Euro and include statutory value added tax.
(2) Shipping costs are charged in addition to the item price. They are shown separately in the shopping cart and again at checkout before you submit your order. Shipping is charged once per order at a flat rate:
(3) For deliveries outside the European Union, additional customs duties, import taxes and handling fees may be levied by the destination country. These are borne by you and are not included in our prices.
(4) Payment is made by the methods offered at checkout, processed by Stripe Payments Europe Ltd. Payment is due immediately upon conclusion of the order.

§ 4 Delivery and Transfer of Risk
(1) We deliver to the countries selectable at checkout. Delivery is currently limited to the European Union and Switzerland.
(2) Goods are produced in small runs. Delivery takes place within [14] days of conclusion of the contract unless stated otherwise on the product page.
(3) If you are a consumer, the risk of accidental loss or deterioration passes to you upon handover of the Goods to you or to a person designated by you, irrespective of whether the shipment is insured.
(4) We are entitled to make partial deliveries where reasonable for you. Any additional shipping costs for partial deliveries are borne by us.
§ 5 Retention of Title
The Goods remain our property until the purchase price has been paid in full.
§ 6 Right of Withdrawal
RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and designated by you, took possession of the Goods. Where an order comprises several items delivered separately, the period runs from the day on which you took possession of the last item.
To exercise your right of withdrawal you must inform us — Softdrive® Foundry, Görlitzer Straße 52, 10997 Berlin, Germany, email: [support@softdrivefoundry.com] — by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw. You may use the model withdrawal form below, but this is not obligatory. To meet the withdrawal deadline it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
CONSEQUENCES OF WITHDRAWAL
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in no event will you be charged any fees for such reimbursement.
We may withhold reimbursement until we have received the Goods back, or until you have supplied evidence of having sent back the Goods, whichever is the earlier.
You shall send back the Goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal. The deadline is met if you send back the Goods before the period of fourteen days has expired. You will bear the direct cost of returning the Goods. You are only liable for any diminished value of the Goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Goods.

§ 7 Warranty
(1) Statutory warranty rights apply in accordance with §§ 434 et seq. of the German Civil Code (BGB). The limitation period for claims based on defects is two years from delivery of the Goods.
(2) Slight variations in colour, texture and dimensions are inherent to small-batch production and do not constitute a defect, provided they are reasonable for you.
§ 8 Limitation of Liability
(1) We are liable without limitation for damages arising from injury to life, body or health, for damages caused intentionally or by gross negligence, and under the German Product Liability Act.
(2) In the case of slight negligence, we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases our liability is limited to the foreseeable damage typical for this type of contract.
(3) Any further liability is excluded.
§ 9 Final Provisions
(1) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, this choice of law does not deprive you of the protection of mandatory provisions of that country.
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions is not affected.
